Terms of Service

1. Scope and Provider
These Terms of Service govern your use of both the Lucendo™ Leadership App (‘App’) and the Lucendo™ website (www.getlucendo.com) (‘Website’). Unless otherwise specified, all references to the ‘Service’ in these Terms include both the App and the Website

2. Subject Matter and Services
Lucendo provides a leadership assessment and development platform that allows users to:
- Complete leadership self-assessments and 360° feedback
- Receive scored evaluations across 24 leadership domains and 6 areas
- Benchmark against anonymized peer data
- Generate a personalized development plan

The App is designed for individual and professional use.

3. User Registration and Obligations
To access the full functionality, users must:
- Register an account with a valid email address
- Provide accurate personal and professional information
- Keep login credentials secure and confidential

Eligibility: The App is not intended for children under 16 in the EU/EEA or under 13 in the United States. By registering, you confirm that you meet the minimum age requirements under applicable law.
Users agree not to misuse the platform, manipulate results, or attempt unauthorized access.


4. Fees and Subscriptions
Lucendo offers a free preview and paid Core and Pro subscriptions. Details of pricing and features are available in-app. Payment processing and renewals are handled by the respective app stores (Apple App Store or Google Play). Subscriptions renew automatically unless cancelled in accordance with the app store policies.

5. Cancellation and Termination
Users may cancel their subscription at any time via their app store account settings. Access continues until the end of the billing period. Refunds, if any, are subject to the policies of Apple and Google. Lucendo reserves the right to suspend or terminate accounts in case of abuse, non-payment, or breach of terms.

6. Intellectual Property
All intellectual property rights in the platform, including design, content, algorithms, and branding, remain the property of Lucendo Leadership Inc. Users may not reproduce, share, or commercially exploit any portion of the App.

7. Limitation of Liability
Lucendo provides leadership analysis and development suggestions but does not guarantee or warrant any specific outcomes, including, without limitation, job placement, promotions, or performance improvements. Lucendo is not a medical or psychological service and does not provide mental health advice or treatment. The App is provided “as is” as a decision-support tool. To the maximum extent permitted by law, Lucendo is not liable for:
- stress, disappointment, or other non-material harms
- indirect, incidental, consequential, or punitive damages (including lost profits, missed promotions, or career outcomes)
- errors, bugs, interruptions, or data loss caused by ordinary negligence, except where liability cannot legally be excluded

Nothing in these Terms limits liability for intentional misconduct, gross negligence, or for injury to life, body, or health where such liability cannot be excluded under applicable law.

8. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, for all users outside the EU. For users in the EU, German consumer law and data protection rights apply additionally.

9. Data Protection and User Consent
By using the Lucendo App, users acknowledge and agree that the collection, processing, and storage of personal and behavioral data is necessary for leadership assessment, scoring, benchmarking, and personalized development recommendations.Lucendo processes data in line with the requirements of:
- General Data Protection Regulation (GDPR) – for users in the European Union
- California Consumer Privacy Act (CCPA) – for users in the United States, where applicable
Types of Data Collected:

Registration and profile data (e.g., name, email, role, team size, years of experience)
- Assessment/behavioral data (your responses to leadership questions)
- 360° feedback data (optional)
- Uploaded job descriptions or goals (optional, for job-fit analysis)
- Usage data (e.g., timestamps, in-app interactions)

Purpose of Data Use:- To calculate leadership scores and insights
- To benchmark users against anonymized peer groups
- To recommend personalized leadership development content
- To support performance diagnostics and role fit analysis

Your assessment results are accessible only to you, unless you choose to share them outside the App. In rare cases, authorized technical administrators may access limited data strictly for maintenance, troubleshooting, or security purposes, under confidentiality obligations.

Data Storage & Hosting:
Lucendo stores all data on secure servers hosted by reputable cloud providers (currently AWS), with appropriate safeguards such as encryption and role-based access controls, in line with applicable data protection requirements. Lucendo uses essential cookies and comparable technologies (such as SDKs) to operate the platform securely and improve the user experience. We do not use advertising cookies, cross-site profiling, or invasive tracking.

User Rights under GDPR (for EU Users):

Right to access, correct, or delete personal data
- Right to restrict or object to processingRight to data portability
- Right to lodge a complaint with a supervisory authority, in particular in your country of residence, if you believe your rights under applicable data protection law have been infringed

Account Deletion and Data Erasure:
If a user deletes their account, Lucendo will delete or anonymize personal data within 30 days, in accordance with GDPR Article 17 (“Right to be Forgotten”). Leadership reports and feedback documents will also be removed or anonymized. Data used for benchmarking or product improvement will be retained only in aggregated, non-identifiable form. Any data retained for legal reasons (e.g., billing records) will be kept securely and not used to identify users. Lucendo does not retain or restore report content after deletion.

We do not use advertising cookies, cross-site profiling, or invasive tracking.

In the event of a personal data breach, Lucendo will notify affected users and relevant authorities as required by applicable law.

10. Changes to Terms and Data Policy
Lucendo reserves the right to update these Terms and Data Protection Provisions. Users will be informed via email or in-app notification. Where required by applicable law, material changes will require renewed acceptance before you can continue using the App.

11. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law principles. You agree that any disputes arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts located in Delaware, United States.
